BY ACCEPTING THIS AGREEMENT OR ACCESSING OR USING THE SERVICE, YOU AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT.

By accessing and using the TextChat Widget (referred to as the “Service” or “Website” and excluding any services provided to you by Battle House Laser Tag under a separate written agreement), you agree to be bound by these Terms of Service.

BATTLE HOUSE TACTICAL LASER TAG – CR6002 – No mobile opt-in data will be shared with third parties or affiliate.

MODIFICATIONS TO THIS AGREEMENT

From time to time, Battle House Laser Tag may modify this Agreement.

NOTIFICATIONS OF CHANGES

Battle House Laser Tag reserves the right, at its sole discretion, to change, modify, update, add, or remove portions of the Terms of Service at any time, with or without notice to you. Please check these Terms of Service periodically for changes. Your continued use of the Website Widget after the posting of any changes to the Terms of Service will be deemed to be your agreement to those changes.

SERVICES

You must provide your Name and Mobile Phone Number in order to use the Services. There is no cost to use the Services, the Services we provide are free. Opting into marketing messages is not a requirement for the use of Services.

Battle House Laser Tag uses every effort to ensure that access to our Services is available to you. You agree, however, that there may be times, scheduled and unscheduled, where services will be unavailable. We will attempt to notify you about the planned operations and the unavailability of the service but are not legally required to do so. Despite all efforts, Battle House Laser Tag is not responsible for any loss of service which occurs as a result of or non-availability of the service.

Battle House Laser Tag makes no guarantee that all the chat texts will be delivered without any problem to all visitors of the Website because of the variety of browsers, devices, service providers, and/or their versions. Also in some, mainly old, browsers it is not possible to display the chat window or it may not be displayed correctly. In any case, we are not liable if the chat window is not displayed correctly or SMS messages not being delivered to the End User.

THIRD PARTIES

If you use Battle House Laser Tag TextChat on the account of a Third Party or a third party uses the service through your account, you declare and guarantee that (i) you are authorized to act on behalf of the third party and that the third party is bound by this agreement and (ii) you will not give or share customer information with third parties.

PROPRIETARY RIGHTS

This agreement is relating to the Services provided by Battle House Laser Tag and you are not given any permission for any software. You may not in any way, directly or indirectly: reverse engineering, disassemble or attempt to discover the source code, algorithms, or data related to the services of Battle House Laser Tag. You should not remove or modify any information about the Services, and create derivative work based on Battle House Laser Tag. The services that you can access from your account should be used exclusively by your business and you have not the right to share or resell the services in any way in favor of third parties.

DATA PROCESSING CONSENT, PURPOSE, RETENTION PERIOD, REVOCATION

I agree for my personal data, provided via chat, to be processed by Battle House Laser Tag for the purposes of providing support via chat and SMS messaging. I agree for my personal data to be processed for the time [e.g. needed to carry out the service]. I understand that the consent may be revoked by sending an email to Battle House Laser Tag.

COMMUNICATIONS FROM Battle House Laser Tag

Use of the Service may include certain SMS communications from Battle House Laser Tag for operational, non-marketing, or administrative purposes (such as alerting you of changes that you have subscribed to receive or for customer service purposes). You understand that these communications shall be considered part of using the Service.

RESTRICTIONS ON USE OF THE SERVICE

All messages, information, videos, or other content, whether publicly posted, displayed or performed on, or privately transmitted, are the sole responsibility of the person who sends or publishes such items. Accordingly, you are responsible for all items that you record, upload, post, cause a display, playback, or performance of, SMS, transmit or otherwise make available via the Services.

Battle House Laser Tag reserves the right to but has no obligation to, monitor or screen the content posted and/or displayed or performed on the Website and to remove any content in its sole discretion. Nevertheless, YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT YOU RECORD, UPLOAD, POST, CAUSE TO BE DISPLAYED, PLAYED BACK, OR PERFORMED IN ANY AREAS OF THE WEBSITE AND THAT YOU TRANSMIT IN ANY OF YOUR COMMUNICATIONS THAT USE THE WEBSITE AND THE SERVICE PROVIDED THEREBY.

a. Use of Customer Data. As between the parties, Customer and its licensors retain all rights, title, and interest (including any and all intellectual property rights) in and to the Customer Data and any modifications made thereto in the course of the operation of the Services. Subject to the terms of this Agreement, Customer hereby grants toBattle House Laser Tag and its Affiliates a non-exclusive, worldwide, royalty-free right to process the Customer Data solely to the extent necessary to provide the Services, Software, Mobile Apps, and perform all related obligations owed to Customer under this Agreement, or as may be required by law. Customer is solely responsible for the accuracy, content, and legality of all Customer Data. Customer warrants that Customer has and will have sufficient rights in the Customer Data to grant the rights to Battle House Laser Tag under this Agreement.

b. Data Security. The parties will comply with the terms of the Data Processing Addendum(“DPA”) which is incorporated into this Agreement by this reference, with respect to the provision and processing of Personal Data as defined in the DPA. Battle House Laser Tag will use appropriate technical and organizational measures in the Services to protect the Customer Data from unauthorized access, processing, loss, or disclosure. Battle House Laser Tag measures are designed to provide a level of security appropriate to the risk of processing the Customer Data within the Services. Customer understands that Battle House Laser Tag and its Affiliates will process Customer Data in accordance with applicable data protection laws, this Agreement, including the DPA, and the Privacy Notice.

ACCEPTANCE OF TERMS AND CONDITIONS

By subscribing for and or receiving the supply of the Services, you accept these Terms and Conditions.

ENTIRE AGREEMENT

This Agreement, and any documents referred to in it, constitute the whole agreement between the parties and supersede any previous arrangement,
understanding or agreement between them.
